Terms of Service

The terms governing use of PayKunda's APIs and services.

1. Acceptance of Terms

By accessing or using PayKunda's services, APIs, website, or any related products (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Services on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.

2. Description of Services

PayKunda provides payment infrastructure APIs that enable businesses to:

  • Send payouts via mobile money, bank transfers and card disbursements
  • Process utility payments including airtime, electricity, water, internet and TV
  • Settle cross-border transactions using local currency or stablecoin rails
  • Access payment services across 40 countries in Africa, Asia and the Americas

3. Account Registration

To use our APIs, you must create an account and provide accurate, complete registration information. You are responsible for:

  • Maintaining the confidentiality of your API keys and credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account
  • Completing identity verification (KYC) as required by applicable regulations

4. Acceptable Use

You agree not to use the Services to:

  • Violate any applicable laws, regulations, or third-party rights
  • Process transactions involving illegal goods, services, or activities
  • Engage in money laundering, terrorist financing, or sanctions evasion
  • Submit false, misleading, or fraudulent transaction information
  • Interfere with, disrupt, or overload our infrastructure
  • Reverse engineer, decompile, or attempt to extract our source code
  • Resell, sublicense, or redistribute our APIs without authorization

5. Fees and Payments

Fees for the Services are set forth in your pricing agreement or on our pricing page. You agree to:

  • Pay all applicable fees in accordance with your billing terms
  • Provide valid and up-to-date payment information
  • Accept that fees may be updated with 30 days' prior notice

All fees are non-refundable unless otherwise stated in writing. Transaction fees are deducted at the time of processing.

6. Transaction Processing

PayKunda processes transactions on a best-effort basis. While we strive for high reliability, we do not guarantee that every transaction will be completed successfully. Transaction failures may occur due to:

  • Insufficient funds or invalid recipient details
  • Network outages at mobile money operators or banks
  • Regulatory holds or compliance screening flags
  • Technical issues with third-party payment providers

Failed transactions will be reported via webhooks and API responses. Funds for failed disbursements will be returned to your account balance.

7. Compliance

You are responsible for ensuring your use of the Services complies with all applicable laws and regulations in the jurisdictions where you operate, including:

  • Anti-money laundering (AML) and know-your-customer (KYC) requirements
  • Data protection and privacy regulations
  • Financial services licensing requirements
  • Sanctions and export control regulations

8. Intellectual Property

All intellectual property rights in the Services, including our APIs, documentation, branding and software, are owned by PayKunda. You are granted a limited, non-exclusive, non-transferable license to use the Services in accordance with these Terms.

9. Confidentiality

Both parties agree to keep confidential any non-public information shared during the course of the business relationship. This includes API keys, transaction data, pricing terms and technical documentation marked as confidential.

10. Limitation of Liability

To the maximum extent permitted by law, PayKunda shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities, arising from your use of the Services.

Our total liability for any claims arising under these Terms shall not exceed the fees paid by you to PayKunda in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless PayKunda, its officers, directors, employees and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Services, your violation of these Terms, or your violation of any third-party rights.

12. Suspension and Termination

We may suspend or terminate your access to the Services if:

  • You breach these Terms or our Acceptable Use Policy
  • We are required to do so by law or regulatory order
  • Your account is flagged for suspicious or fraudulent activity
  • You fail to pay applicable fees

You may terminate your account at any time by contacting us. Upon termination, your right to use the Services ceases immediately.

13. Modifications

We may modify these Terms from time to time. Material changes will be communicated at least 30 days in advance via email or a notice on our website. Continued use of the Services after changes take effect constitutes acceptance of the modified Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of The Gambia. Any disputes arising under these Terms shall be resolved through binding arbitration in Banjul, The Gambia.
